2. Services
We provide digital services: mobile and web application development, interface design, backend and data work, store releases, subscription and payment integration, and post-launch support.
The specific scope, timeline and fee for any engagement are set out in a separate written agreement, quotation or invoice. Material on this website is provided for information and does not constitute a binding offer.
3. Orders and acceptance
An enquiry submitted through the website or by email is a request, not a contract. A contract is formed when the scope has been agreed in writing and the invoice, or an agreed part of it, has been paid.
We may decline an engagement, including where the work falls outside our competence or would be unlawful.
4. Fees and payment
Fees are set by the agreed scope. Unless stated otherwise, work begins once the initial payment has been received.
Amounts are stated exclusive of bank charges and of any taxes payable in the client's jurisdiction, unless the invoice states otherwise.
5. Client responsibilities
The client provides materials, access and feedback in good time, and confirms that it holds the rights to everything it supplies: text, images, trade marks and source code.
Where materials or approvals are delayed, delivery dates move by the corresponding period.
6. Intellectual property
Rights in the deliverables created for the client transfer to the client on payment in full for the relevant stage, unless agreed otherwise in writing.
We retain the right to use general methods, know-how and libraries created before or outside the engagement, and to state that we worked with the client and show the result in our portfolio unless the client objects in writing.
7. Confidentiality
Neither party will disclose non-public information received during the engagement, except where required by law or where disclosure to a subcontractor is necessary to perform the work.
8. Warranties and liability
We perform the services with reasonable care and skill. We do not warrant any particular commercial outcome: approval timelines, install numbers, search positions, traffic volume or revenue depend on the market, on the platforms and on decisions the client makes.
Our total liability for any claim is limited to the fees actually paid for the work to which the claim relates. We are not liable for loss of profit or for indirect or consequential loss.
We are not responsible for interruptions to third-party services (hosting, app stores, payment providers, advertising platforms) or for the consequences of changes to their rules.
Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Term and termination
Either party may end the engagement by written notice. Work completed up to that point is payable; refunds of prepayments are dealt with in the Refund and Return Policy.
10. Governing law
These terms are governed by the law of England and Wales. Disputes that cannot be resolved by discussion are subject to the courts of England and Wales.
11. Changes
We may update these terms. The version published on this page when the contract is formed is the one that applies. The date of the current version is shown at the top of this page.
